This policy defines the Contractual User Agreement Policy between you, the Customer (as so defined in the Service Application Form) and Nexlink Communications. Nexlink Communications may be referred to as “Nexlink Communications”, “we”, “company”, “us” or “our” within the contractual terms set out below. Breach of these contractual terms can result in immediate cancellation of your account.
Following are the terms and conditions for use of Internet services provided by Nexlink Communications.
By using your account, you agree to adhere to the terms set out below.
- Upon signing the “service application form”, you are subject to a waiting period between 40-45 working days before service installation commences and the wireless internet service becomes effective. During this period you may cancel the service however you will be subject to pay a cancellation fee. The Cancellation Fee amounts to 10% of the total cost of the Original Invoice.
- Customer must be 18 years or older in order to start an account with Nexlink Communications.
- Nexlink Communications enforces these policies with respect to the Nexlink Communications Customer only. We are not responsible for abusive actions which originate from other sites or networks on the Internet.
- The Customer is responsible for keeping billing data with Nexlink Communications up-to-date and accurate. Furnishing false data on the signup form or contract is grounds for immediate cancellation.
- Payments for monthly invoices are due on or before the 7th day of the month which covers a FULL month of internet services or a prorated amount to reflect the actual number of days use upon service installation.
- All monthly invoices shall be sent electronically via the email address given by the customer at the time of service activation. Failure to receive invoice shall not constitute an acceptable excuse for late payment of nonpayment.
- Failure to pay within the first 8 calendar days of the month warrants the suspension of the account within our data system. The account will be deleted from our data system after sixty days of non-payment; however, if you choose to reactivate the account, you will incur a $3000.00+vat (Guyana Dollars) reactivation fee. THERE WILL BE NO EXCEPTIONS TO THIS CONTRACTUAL TERM.
- Charges will be billed according to the price list currently in effect at the time. Accounts are billed monthly, quarterly, or annually. For quarterly and annual term billing commitments, you are responsible for the entire length of the term; refunds are not available for unused months and bandwidth.
- If a customer wishes to cancel service, a written notice must be submitted requesting the service to be disconnected a month before cancellation, pertaining that ALL DUE INVOICES are paid.
- CUSTOMER AGREES TO DEFEND, INDEMNIFY AND HOLD HARMLESS PROVIDER AND ANY THIRD PARTY ACTING ON BEHALF OF PROVIDER FOR ANY CLAIMS (INCLUDING, BUT NOT LIMITED TO ANY CLAIMS FOR NEGLIGENCE, GROSS NEGLIGENCE, OR WILLFUL MISCONDUCT BY PROVIDER OR ANY THIRD PARTY ACTING ON BEHALF OF PROVIDER) AND FOR ANY LOSSES, DAMAGES, LIABILITIES OR COSTS INCURRED BY PROVIDER (INCLUDING, WITHOUT LIMITATION, ATTORNEY’S FEES, DEFENSE COSTS AND EQUITABLE RELIEF) ARISING OUT OF OR IN ANY MANNER RELATED TO THIS AGREEMENT OR THE SERVICES PROVIDED BY PROVIDER OR ANY THIRD PARTY ACTING ON BEHALF OF PROVIDER.
- Security deposits paid to Nexlink Communications for Dedicated Bandwidth Services are non-refundable. A written notice must be submitted requesting the service to be disconnected one (1) month prior to cancellation. The security deposit is applied towards the last month of service.
- Standard Installation includes the mounting of an antenna to the exterior of the house and/or building of the party contracting the service. The installation and routing of cable(s) by the most direct path to the computer and/or router at the customer’s premises. Any additional wiring will incur charges.
- Connecting multiple computers, routers, or other equipment on your premises will require an additional service charge for the equipment and wiring.
- Electrical Power and Damages
- NexLink Communications will not be held responsible for any damages to the antenna/router to the following:-
- Electrical surge/spike/illegal connection
- Failure to use Uninterruptible Power Supply (UPS) to boot up antennas or routers.
- Poor electrical grounding
- NexLink Communications Technicians will document on service form if the antenna/router is connected to a stable power source such as a UPS or surge protector.
- NexLink Communications will not be held responsible for any damages to the antenna/router to the following:-
- During peak and off-peak periods, NexLink Communications maximum download and upload bandwidth do not provide any guarantees on data transmitted from Nexlink Communications base of operations to the internet user, meaning that the customer obtain unspecified variable bit rate and delivery time, depending on the current traffic load.
- Nexlink Communications will not be liable for any damages to customers’ premises and electrical equipment that result from the installation/removal of wires or antenna, including any holes in walls due to cable wiring or antenna mounting brackets, lost of files, data or peripherals. In the event that you the customer are a tenant, we will not be liable as third parties to any legal dispute between you and your landlord. At all times we will exert great care and caution to ensure the installation is reasonably appealing.
- Wireless Antennas purchased by the customer from NexLink Communications is the sole property of the customer.
- We do not provide compensations for this contracted service. Nexlink Communications is not responsible for any damage to any electronic equipment that uses our service as their internet service provider. We are not responsible for damage that may be caused to your electrical equipment as a result of a power outage, fluctuation, physical abuse and natural disasters.
- ALL site visits/service calls include additional charges based on customer location and nature of the visit.
- Nexlink Communications is not responsible for maintaining or supporting your electrical equipment or other equipment personally owned.
- Customer shall not use any kind of program, script, command, or send messages of any kind, designed to interfere with a user’s terminal session, via any means, locally or by the Internet.
- Harassment, whether through language, frequency, or size of the message, is prohibited.
- Customer shall not forward or otherwise propagate chain letters, whether or not the recipient wishes to receive such mailings.
- Nexlink Communications reserves the right to share any of your personal information we collect with law enforcement authorities whether it is locally or internationally to aid in ongoing investigations of suspected criminal violations.
- Nexlink Communications reserves the right to occasionally update the contractual terms of this policy. We will also revise the “last updated” date at the bottom of the contractual agreement document.
- Nexlink Communications reserves the right to restrict or terminate service without refund in the event of a violation of the User Agreement Policy. Nexlink Communications also reserves the right to take action on abuse which is not specifically named in this User Agreement Policy, at the sole discretion of Nexlink Communications.
By signing this Contractual User Agreement Policy you have read and fully understand the contractual terms and will act in compliance with the terms as set out above.
